Terms of Service
These terms are an agreement between you and Stella Viae LLC ("we", "us") about the Earsona app and this website. Contact us at earsona@stellaviae.com. By using Earsona, you agree to these terms.
App license
Earsona is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms supplement the Standard EULA; if they conflict, the Standard EULA controls for your license to the app. These terms don't replace the Standard EULA or limit rights you have under it or under mandatory law. Third-party open-source components are governed by their own licenses, listed in Earsona's open-source acknowledgments.
Who can use Earsona
Earsona is available where the App Store distributes it. You need to be able to agree to these terms, or have a parent or guardian's permission, and meet the minimum age and other requirements of the music service you connect.
Support
Stella Viae LLC, not Apple, is responsible for Earsona and its support. Contact us for help with the app; see the support page. Your music provider manages its own subscriptions, accounts and content.
Music services
Earsona provides personal listening features and optional spoken song and artist information. You need an eligible account, and any required subscription, for the music service you choose. Spotify playback requires Spotify Premium, and Apple Music catalog playback requires eligible Apple Music access. Earsona doesn't include those subscriptions, ownership of recordings, download or export rights, public-performance rights, or any guarantee that third-party services will stay available.
Full playback from Amazon Music and YouTube Music isn't currently available. A link that opens a music service doesn't give you in-app playback. Catalog, region, network and account status can affect which features work. Planned features aren't promises.
Earsona is independent and isn't endorsed by, sponsored by or affiliated with Spotify, Apple, Amazon or any other music service unless we say so with their permission.
Acceptable use
Use Earsona lawfully and follow the terms of your music services and device. Don't share your credentials, misuse a service's access, interfere with Earsona or the services it connects to, or use the app to infringe anyone's rights. These restrictions don't remove rights you have under mandatory law or an open-source license.
Spoken information
Artist origins, release details and pronunciations come from public sources and on-device speech, and they may be incomplete or wrong. Unknown or ambiguous facts may be left out. They're for personal listening, not factual certification or professional advice. You can report a correction to earsona@stellaviae.com.
You choose your announcement settings and control playback. Signing in, reauthorizing a service, or recovering after a force-quit or restart may require opening the app. We don't guarantee uninterrupted background playback, support for every headset control, exact Bluetooth timing or perfect pronunciation. Please listen safely and follow local rules, for example while driving.
Price
Earsona is free. There's no premium unlock, subscription or other purchase offered. If we ever offer a paid feature, it will come with its own clear offer and purchase terms; these terms don't authorize any charge.
Privacy
Our Privacy Policy explains how information is handled. Removing Earsona's connection to a music service doesn't close your account with that service.
Spotify
Spotify's platform, service and content are provided under Spotify's terms. To the extent the law allows and the governing Spotify agreement requires, Spotify disclaims all warranties and liability relating to Earsona, and Spotify is an intended third-party beneficiary of these terms, entitled to enforce the provisions that apply to it. Don't modify, reverse engineer or otherwise misuse Spotify's platform, service or content, except where the law permits.
Disclaimers
To the extent the law allows, Earsona and this website are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Some places don't allow these exclusions, so they may not apply to you. Any warranty Apple owes you under the Standard EULA is unaffected.
Limitation of liability
To the extent the law allows, Stella Viae LLC isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of Earsona or this website. Nothing in these terms limits liability that can't be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
Ending use
You can stop using Earsona at any time by disconnecting your music services and deleting the app. We may suspend or end your access if you misuse Earsona or break these terms, or if a music provider requires it. We may also change or discontinue Earsona. Sections that by their nature should continue, such as disclaimers, limits of liability and governing law, survive.
Governing law and disputes
These terms are governed by the laws of the State of Kansas, USA, without regard to conflict-of-laws rules. Disputes will be heard in the state or federal courts located in Kansas. If you're a consumer, you keep any protections and any right to bring a claim in your local courts that the law of your country gives you. If something goes wrong, please email us first so we can try to resolve it informally.
Changes to these terms
When we update these terms, we'll post the new version here with a new effective date. For material changes, we'll also give notice on this website or in the app before they take effect. If you keep using Earsona after the changes take effect, the updated terms apply, to the extent the law allows.
General
If any part of these terms can't be enforced, the rest stays in effect. If we don't enforce a provision right away, we haven't waived it. These terms, the Standard EULA and our Privacy Policy are the whole agreement between you and us about Earsona.
